Terms of Service

These Terms of Service ("Terms") govern your use of the cybersecurity assessment and risk management platform operated by Monmer Security B.V. ("Company," "we," "our," or "us"). By accessing or using our Service, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our Service. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

Our Service provides cybersecurity assessment tools, risk management capabilities, and external attack surface monitoring (EASM) to help organizations evaluate and improve their security posture. The Service includes:

• Security framework assessments and compliance evaluations
• Risk register management and monitoring
• External attack surface discovery and analysis
• Reporting and analytics dashboards
• Organization and user management features

To use our Service, you must create an account and provide accurate, current, and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your account information remains accurate and up-to-date

You must be at least 18 years old to create an account and use our Service.

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Upload, transmit, or distribute malicious software or harmful code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers
• Use the Service for any illegal or fraudulent activities
• Reverse engineer, decompile, or attempt to extract source code
• Resell, redistribute, or provide access to the Service to third parties
• Use automated tools to access the Service without our consent

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection, use, and processing of your data as described in our Privacy Policy.

You retain ownership of any data you submit to the Service. You grant us a limited license to use, process, and store your data solely to provide the Service and improve our platform.

The Service, including all software, content, trademarks, and other intellectual property, is owned by Monmer Security B.V. or our licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

You may not copy, modify, distribute, sell, or lease any part of our Service without our explicit written consent.

We strive to maintain high availability of our Service but cannot guarantee uninterrupted access. We may:

• Perform scheduled maintenance that may temporarily affect availability
• Modify, suspend, or discontinue any part of the Service
• Update features, functionality, or security measures
• Implement usage limits or restrictions

We will provide reasonable notice of significant changes when possible.

If you subscribe to a paid plan, you agree to pay all applicable fees. Payment terms include:

• Fees are charged in advance on a recurring basis
• You authorize us to charge your payment method
• Fees are non-refundable except as required by law
• We may change our pricing with 30 days' notice
• Failure to pay may result in account suspension or termination

Either party may terminate this agreement at any time. We may suspend or terminate your account if:

• You violate these Terms or our Acceptable Use Policy
• Your account remains inactive for an extended period
• We discontinue the Service
• Required by law or regulatory authority

Upon termination, your right to use the Service will cease immediately, and we may delete your data according to our data retention policy.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM. WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

You agree to indemnify and hold harmless Monmer Security B.V., its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the Netherlands Arbitration Institute, or in the competent courts of the Netherlands.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The failure to enforce any right or provision will not constitute a waiver of such right or provision.
